Options for Hiring in Denmark

Opening Up an Entity

If fast hiring is a priority, setting up an entity in Denmark might not be the best option. It usually takes months since it requires a nuanced understanding of local labor laws.

You’ll need to:

  • Set up a local branch with a local bank account

  • Register with local institutions

  • Maintain a presence in the country

  • Find law partners

  • Hire an accounting firm to run payroll

  • Hire an internal HR team

Many businesses partner with a global EOR service to save time and money on local entity setup.

Protections Against Discrimination

In Denmark, the Danish Equal Pay Act, the Danish Act on Equal Treatment, and the Danish Act on Anti-Discrimination prohibit workplace discrimination.

The Equal Pay Act limits gender-based discrimination when determining wages and salary. Discrimination prohibitions in collective bargaining agreements take precedence over those in the Equal Pay Act.

The Equal Treatment Act restricts gender-based discrimination during interviews, hiring, or employment.

The Anti-Discrimination Act prohibits discrimination during hiring or employment based on race, skin color, religious beliefs, political views, sexual orientation or identity, national or ethnic origin, age, or disability.

Drafting Employment Agreements

Employees in Denmark who work over three hours weekly are entitled to a written statement detailing important terms and conditions of employment.

According to the Danish Act on Employment Contract, an employment contract must include:

  • Name and addresses of employer and employee

  • Place of work (whether onsite or remote)

  • Description of work, title, duties, and job category

  • Start date

  • Expected duration (only for fixed-term contracts)

  • Probationary periods (when applicable)

  • Right to paid leave, including holiday leave and parental leave

  • Terms of notice and termination

  • Frequency and amount of salary payment

  • Normal weekly working hours

  • Work pattern (if the work pattern is unpredictable)

  • Training and education entitlements

  • Information and identity of the social security institution receiving the contributions

  • Any collective bargaining agreements
